We do not maintain a physical retail storefront. * You may not use our Products for any illegal, unauthorized, or unintended purpose. * A breach or violation of any of these Terms will result in an immediate termination of your access to our services. 2. We are an independent creator and retailer of aftermarket vinyl decals and hobbyist styling products. Porsche AG, Porsche Cars North America, or any of their subsidiaries or affiliates. * Nominative Fair Use: The term "Porsche," alongside specific vehicle model names (including but not limited to 911, GT3, Cayman, Boxster, Cayenne, Macan, Taycan), is used on this Site strictly for nominative, descriptive, and comparative purposes. This use is intended solely to identify structural compatibility with specific vehicle aesthetics or to describe enthusiast-themed artistic designs for hobbyists. * No Consumer Confusion: Nothing on this Site is intended to imply that the Products sold are factory-authorized or official merchandise of Dr. Ing. h.c. AMATEUR & LEAGUE TRADEMARK DISCLAIMER Graphics for Porsche is not affiliated with, sponsored by, or endorsed by any professional sports leagues (e.g., NFL, NBA, MLB, NHL, MLS, FIFA), trading card manufacturers (e.g., Panini, Topps, Upper Deck, Bowman), or card grading companies (e.g., PSA, BGS, SGC, CGC). Any use of team colorways, thematic patterns, or numeric layouts is strictly artistic, transformative, and designed to customize protective accessories. 4. ASSUMPTION OF RISK & TRADING CARD CARE DISCLAIMER You expressly acknowledge and agree that the Products sold on graphicsforporsche.com are designed, manufactured, and intended STRICKLY for application on protective plastic card holders, toploaders, acrylic magnetic cases (One-Touches), and graded plastic slabs. * No Direct Card Application: You agree never to apply vinyl graphics or adhesive products directly onto an unprotected physical trading card, sports card, autograph, or piece of physical sports memorabilia. * User Application Responsibility: Proper application, alignment, and removal of vinyl graphics require care. Graphics for Porsche provides no warranty regarding the ease of removal or the chemical interaction of vinyl adhesives with third-party plastics, acrylics, or paper grading labels over time. * Full Release of Liability: By purchasing our Products, you assume all risk associated with their installation, use, handling, and removal. Graphics for Porsche shall not be held liable for any direct, indirect, incidental, or consequential damages to your personal property, including but not limited to: the scratching, cracking, or clouding of card holders; damage to grading company labels; or the physical damage, alteration, or financial devaluation of any trading cards contained therein. 5. PRODUCT ACCURACY & MONITORS We attempt to display product colors and textures as accurately as possible on our Site. However, because computer monitors and mobile screens display colors differently, we cannot guarantee that your screen's display of any color will be 100% accurate to the physical vinyl sheet received. We do not offer refunds or exchanges based solely on perceived monitor color discrepancies. 6. MODIFICATIONS TO PRICES AND SERVICES * Prices for our products are subject to change without notice. * We reserve the right at any time to modify or discontinue any product, design, template, or service without notice. * We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the service. 7. SHIPPING & DELIVERY ERRORS Because we operate entirely online, physical product delivery relies on third-party shipping carriers. * Processing Time: Orders are processed within standard operational windows. Custom orders or custom text cuts may require additional design and fabrication timelines. * Carrier Failures: We are not responsible for delivery delays, lost packages, theft, or items delivered to an incorrect address provided by the buyer. Please double-check your shipping and billing address before finalizing your purchase. 8. RETURNS, REFUNDS, AND INSTALLATION FAILURES Our policy regarding returns and refunds is strictly governed by the following parameters: * Precut & Custom Vinyl: Because our items are cut-to-order, we do not accept returns or exchanges on custom text, custom colorways, or specific custom size configurations unless there is a proven manufacturing defect prior to backing removal. * Application Errors: We do not offer refunds, store credit, or free replacements for vinyl graphics that were damaged during user installation (e.g., tearing, stretching, bubbles, crooked alignment, creases, or dust trapped under the vinyl). 9. INTELLECTUAL PROPERTY All content included on this Site—such as text, layout, graphic arrangements, proprietary vector cutting layouts, templates, logos, images, and digital downloads—is the property of Graphics for Porsche and protected by copyright and intellectual property laws. You agree not to reproduce, duplicate, reverse-engineer, copy, digitize, sell, or resell our unique vinyl layout designs or physical cutting templates. 10. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF OUR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THE SITE AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. CAP ON LIABILITY: IN THE EVENT THAT GRAPHICS FOR PORSCHE IS FOUND LIABLE FOR ANY CLAIMS UNDER THESE TERMS BY A LEGAL BODY OF COMPETENT JURISDICTION, YOU AGREE THAT OUR TOTAL MAXIMUM COLLECTIVE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL BE STRICTLY LIMITED TO THE EXACT TOTAL DOLLAR AMOUNT YOU PAID TO US FOR THE SPECIFIC ORDER GIVING RISE TO SAID LIABILITY. 11. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Graphics for Porsche and our parent, subsidiaries, affiliates, partners, officers, directors, agents, and contractors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party (including trademark or copyright claims). 12. MANDATORY ARBITRATION AND CLASS ACTION WAIVER Please read this section carefully, as it directly affects your legal rights. * Mandatory Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the purchase and use of our Products shall be settled exclusively by binding, individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, rather than in a court of law. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. * Class Action Waiver: YOU AND GRAPHICS FOR PORSCHE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. 13. GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Products or Services shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any legal actions not subject to arbitration must be brought in the state or federal courts located within the state of New Jersey. 14.
